Protected Trusts
The next level of Asset Protection involves the use of Protected Trusts, including what is known as Domestic Asset Protection Trusts (DAPTs). Eleven states have now adopted favorable legislation that provides asset protection to self settled Trusts.
Offshore Trusts include much of the same strategy utilized in domestic planning, but instead of assets being located domestically, they are placed offshore for even greater protection. The principal benefit of going offshore is that the assets and structure are placed outside of the jurisdiction of the US court system. The benefits of going offshore are discussed in much more detail on www.WhyGoOffshore.com.
Advanced Estate Planning techniques such as Charitable Remainder Trusts, Grantor Retained Annuity Trusts and Irrevocable Life Insurance Trusts are tied into estate tax savings and passing assets to future generations. At the same time, the implementation of these strategies can also result in substantial Asset Protection Planning benefits.
